Judge: traffic fines in Netherlands for years too high

Traffic Violators have paid for years to hefty fines. According to a ruling by a court in Arnhem. The fines were increased in order to fill the state coffers, and that is not authorized by a magistrate.

media_xl_3402628-13.jpgThe magistrate made the ruling in a case brought by a motorist from Nijmegen. The man was in 2014 a fine of 32 euros because he drove five kilometers too hard. He did not agree with the amount of the fine and appealed. The Subdistrict Court held in his favor.

Inflation correction
It is customary that the fines be adjusted for inflation. But in 2008, 2011 and 2012 are the fines with a higher percentage increase than was necessary to implement the inflation.

According to the subdistrict court in Arnhem is not allowed to fill the state coffers in this way. After adjustment of the amount the state to the man from Nijmegen have to repay a sum of 9 euros.

Tap fingers minister
It is the ruling of a district judge, which is not the highest court. But, according to law professor Henny Sackers the decision may have a significant impact.
