The Court in Almelo a motorist objected set against the amount of a traffic unsuccessful.

The statement is in direct contrast with a previous judgment of the district court of Arnhem on October 30th. Which ruled that the traffic fines by the Minister with wrong motives have been raised, namely fill government coffers. The State had to in this case the objector to repay part of the fine imposed.

In the case in Almelo revolves around a motorist who had to pay 287 euros for speeding in urban areas. The man went to court and referred to the judgment of 30 October in Arnhem.

Higher yield

However, the Court in Almelo come to a different conclusion than his colleague. The minister has the right to introduce changes, such as in this case the increase in traffic fines for a higher yield for the treasury.

Furthermore points out the Court that any change in rates is submitted to both the Second and the Senate and have not ruled against it.

According to the Court in Arnhem in 2008, 2011 and 2012 fines with a higher percentage increase than was necessary to implement the inflation. The increase was only intended to increase government revenues. The judge therefore provided that the increase is contrary to the law.
