OM in cassation against criminal Arnhem Syriëganger

The Public Prosecutor (OM) is appealed to the Supreme Court to the punishment that a Syriëganger Mohammed El A last month was imposed.

The court in Arnhem sentenced to Arnhemmer El A.   eighteen months in jail, one year probation because he was preparing to take part in a terrorist organization.

He was not convicted for participation in a terrorist organization. The prosecution is disagreed.

El A. That money has recruited for a terrorist organization could be proved, but the money the organization was not yet benefited. Therefore, there was only talk of preparation according to the court. The prosecution can not find here and wants to clarify this distinction in the law.

El A. was acquitted of the preparation, facilitation and conniving terrorist offenses. The prosecution believes that the court has used an excessively strict interpretation of the law.

The court ruling is the set of Cassation has not yet become final.

Germany

El A. and his co-defendant Hakim B. were arrested in August 2013 in Germany. In which they hired cars were large quantities of goods which were designed according to the public to join the armed struggle in Syria. The two men themselves claimed that they wanted to give it proper attention.

B. was both by the court and later acquitted by the court on all points. By that judgment explains the OM himself.
