Police no longer suspect after use violence

Police are now no longer automatically labeled as suspicious as they used violence. A fact finding, which is based on lawful act, is in its place. Minister Ard van der Steur (Security and Justice) Tuesday a bill in this regard to, inter alia, the Council sent to the Judiciary and the Public Prosecution Service.

If a police officer is now being prosecuted because he has violated the rules of his so-called rules of engagement, he or she is punished in the same way as someone who is not authorized to use force such as a criminal. But according to Van der Steur, the situation of the other policeman, because he or she has acted out its duties and powers.

On the use of force is a police officer, if the bill is passed, allowing a maximum penalty of three years. However, that punishment is given only if there is a breach fatal. A ministry spokesman stressed that the Public Prosecutor (OM) can always sue under ordinary criminal law an agent in specific cases.

Vulnerable
The change was put into motion after previous bottlenecks in procedures surrounding the police investigation and use of force by police officers. The starting point is to put on and take greater account of the special law - often vulnerable - position of the police officer, says Van der Steur who stressed that he does not want officers keep the existing criminal law.

The bill also ensures that good and thorough investigation is conducted into the circumstances of the use of force and is acted upon whether the rules. The minister, as he insists, the investigating officer will not keep the criminal law. Indeed, he believes that the current legislation is insufficient focus on situations where the police officer acts out his task.
