Naamloos-3113.pngEach year occur approximately 40,000 couples tied the knot. Nearly four in ten couples, 36.88 per cent, choose a marriage contract. According Becq is that the lowest level of the last five years. Using a prenup couples to make clear agreements about what they may or may not want to manage common or partner wishes to assign it in the event of divorce or death.

Six out of ten couples conclude a marriage contract. "However, they do make an implicit choice: these couples fall back on the rules of the legal system which serves as a basic scheme 'Becq explains. "This is roughly system to the following: what is earned and acquired before the marriage remains the property of the person concerned. What happens after the wedding approaches - such as employment income or equity - is part of the community and is distributed upon divorce or death. "

Donations or legacies remain from the donee only during the marriage, unless the donor or testator explicitly decides otherwise. "It is reassuring that more than half of couples agreements within the legal system perceives as a proper translation of what is expected within marriage. A default scheme can only default if a majority of the couples relies on it, 'says Becq.

The 1976 law provided for the possibility of changing marriage contracts or the only exit after marriage. For several years lay solicitors and estate planners strong emphasis here on. In 2015 it was 22 726 changes. "A lot of people are sensitive to the call to pick up their marriage contract under the substance to capture a number of cases where this has not happened yet," says the CD & V MP.
